The court has heard the Boca Del Mar Improvement Association (BDMIA) brief and ordered the county to respond. The court also allowed the developer to intervene on the county’s side. On October 10, both the county and the developer requested a five-day extension to respond, after which the BDMIA will  have 30 days to reply. Peter Sachs is representing BDMIA.

Another lawsuit was also filed by a homeowner backed by several other residents against the commission’s actions. That will follow a similar process as the Association’s lawsuit. Ralf Brookes is representing the homeowner group.

The Boca Del Mar Improvement Association (BDMIA) filed its legal challenge with the courts in August against the zoning decision of the Palm Beach County Board of County Commissioners (BCC) to allow housing development throughout the fairways of the former Mizner Trail Golf Course, which is part of the community’s Master Plan.
