The city of West Palm Beach and developers who want to build a controversial high-rise condo project on the “chapel by the lake” property are appealing a Dec.22 court ruling that blocked the project until it is reviewed by the city’s planning board and sent back to the council again for a vote.

In response, the attorney for Citizens for Thoughtful Growth, Robert Critton, has asked Circuit Judge Catherine Brunson to keep the Citizens’ lawsuit on hold until the results of the city’s appeal are in, according to a Jan. 6 report in The Palm Beach Post. In case the city wins its appeal, Critton said the Citizens wanted the option to continue its lawsuit.

Last February, the Citizens’ group filed suit to block the development on grounds that the city council broke its own rules by not getting a review from its planning board first. A panel of three Palm Beach County Circuit judges agreed with the citizens group.
